Cali appeal court overturn of BI decision may “set a worrying precedent”

California’s Second District Court of Appeal has overturned a lower court ruling that Covid-19 cannot cause physical damage that is sufficient to trigger a contingent business interruption (BI) claim, in a decision analysts say may pave the way for further “unfavourable” appeal judgments against insurers.
